1. Acceptance of Terms
By accessing and using the services provided by Fimi Business Services (“Service Provider”), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please refrain from using our services.
2. Service Scope
Fimi Business Services offers hourly support packages that include, but are not limited to:
- 2-Hour Work Plan Package: Provides efficient, high-quality support within a one-day period.
- 8-Hour Work Plan Package: Provides efficient, high-quality support within one week.
- 10-Hour Work Plan Package: Provides 10 hours of dedicated support (customer inquiries, emails, live chat, phone support, order processing) valid for one week.
- 20-Hour Work Plan Package: Provides 20 hours of dedicated support (including additional services) valid for two week.
- 40-Hour Work Plan Package: Provides 40 hours of dedicated support valid for one month.
Additional services or packages will be clearly described and agreed upon in writing before commencement of work.
3. Refund and Cancellation Policy
- Pre-Paid Services: All services are purchased on a pre-paid basis.
- Usage Period: The purchased time must be used within the validity period specified for each package. Unused time will expire at the end of the validity period and is non-refundable.
- Rescheduling/Cancellation: Services will only be canceled or rescheduled if the Service Provider is at fault. In all other cases, any cancellations will not result in a refund; instead, the remaining time will continue to be available until it expires.
4. Payment Terms
- Pre-Payment Requirement: All payments must be made in full before work commences. We accept payments via Cards and PayPal.
- Notification for Additional Time: Prior to the expiration of the purchased time, we will notify you if additional time is required to complete ongoing tasks.
- Service Pause: Should additional payment not be received after notification, the work will be paused until payment is made.
5. Scheduling and Service Delivery
- Minimum Notice: A minimum of 48 hours’ notice is required for scheduling services.
- Cancellation by Client: If you cancel scheduled services, the time purchased will still be applied to the services rendered until the prepaid time is fully used, subject to the expiration terms outlined above.
6. Intellectual Property & Confidentiality
- Confidentiality: All work, data, and communications exchanged during the provision of services are considered confidential. Both parties agree to maintain strict confidentiality regarding any proprietary or sensitive information shared.
- Intellectual Property: Unless otherwise agreed in writing, all work products provided remain the intellectual property of Fimi Business Services until full payment has been received. Upon receipt of payment, any deliverables provided may be considered the property of the client, subject to any third-party rights or licenses.
7. Limitation of Liability and Disclaimers
- Service Quality: While every effort is made to deliver high-quality support, Fimi Business Services does not guarantee any specific results or outcomes. Services are provided “as is” without any express or implied warranties.
- Liability: Fimi Business Services shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to the use of our services. Our total liability shall not exceed the total amount paid by you for the services in question.
- Force Majeure: Neither party shall be liable for any delays or failures in performance resulting from circumstances beyond their reasonable control.
8. Governing Law and Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of Montego Bay, Jamaica. Any disputes arising out of these terms will be subject to the exclusive jurisdiction of the courts located in Montego Bay, Jamaica.
9. Changes to Terms & Conditions
Fimi Business Services reserves the right to modify these Terms & Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any modifications constitutes your acceptance of the new Terms & Conditions.
